Conclusion
The significance of the Korematsu v. United States and later the coram nobis cases continues to be a relevant discussion today. It is relevant today from not only a legal perspective but also a human perspective. With the benefit of hindsight and without the hindrance of emotion, we can analyze the convergence of factors that led to the case's outcome, 6-3, for the government. We can see that public fear and prejudice, the increased power of the military, and the decision of a Supreme Court led to the denial of the Japanese American's fundamental constitutional rights. During wartime crisis, there has been and will continue to be greater vigilance and scrutiny to protect the individual's civil liberties because of the Korematsu v. U.S. Case.
During times of crisis, the question of the responsibility of the government to keep the nation secure, at the expense of diminished individual rights will always be debated in conjunction with the lessons learned from the Korematsu case. |
